These Terms of Use, together with our Privacy Policy available at https://www.dundaslife.com/privacy (the "Privacy Policy"), constitute the entire agreement between you and Dundas Life Incorporated with respect to your use of the Site and supersede all prior or contemporaneous agreements, understandings, or communications, whether written or oral. You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use and Privacy Policy. Any insurance advice or recommendations are provided based on the information made available to us and are subject to the terms of any separate written agreement entered into between you and Dundas Life Incorporated.
Your use of the Site or communications with Dundas Life Incorporated do not, on their own, establish a client, brokerage, or advisory relationship. Such a relationship is only formed once Dundas Life has agreed to act on your behalf and a written agreement or application has been completed and accepted.
The content on the Site is provided for general information purposes only and is not intended to constitute insurance, financial, or professional advice. You should not rely on the content of the Site as a substitute for advice from a licensed advisor.
The Site is provided from Canada. We do not do business in Quebec, Canada.

All insurance coverage is subject to underwriting, eligibility requirements, and approval by the applicable insurer. You acknowledge that any advice or recommendations provided by Dundas Life are based on the accuracy and completeness of the information you provide. Dundas Life shall not be responsible for any consequences arising from inaccurate, incomplete, or misleading information provided by you.
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us. You agree not to attempt to gain unauthorized access to the Site, interfere with its operation, introduce malicious code, or use any automated means to access, monitor, or copy content from the Site. We reserve the right to investigate and take appropriate action, including cooperating with law enforcement authorities, in respect of any suspected unlawful or unauthorized use of the Site.

Insurance products are provided by third-party insurers. Dundas Life is not responsible for the acts, omissions, decisions, or performance of any insurer, including underwriting decisions, claims handling, or policy administration. Dundas Life will provide services in accordance with applicable laws and industry standards; however, no duties or obligations shall be implied beyond those expressly set out in these Terms of Use or any applicable written agreement.
We reserve the right, but not the obligation, to monitor the use of the Site for compliance with these Terms of Use. We may, in our sole discretion and without notice, investigate any suspected breach of these Terms of Use and take any action we deem appropriate, including restricting or terminating access to the Site.
We may cooperate with law enforcement authorities or comply with any court order or regulatory request requiring us to disclose information relating to your use of the Site.
To the fullest extent permitted by law, you agree to release and hold harmless Dundas Life Incorporated and its affiliates, officers, directors, employees, and agents from any claims arising out of or relating to any actions taken by us in connection with investigations or enforcement of these Terms of Use.
We have no obligation to monitor the Site or its use and make no representations that we will identify or remove any unlawful or inappropriate use. We shall not be liable for any failure to monitor, remove, or restrict access to any content or activity on the Site.
We care about data privacy and security. By using the Site, you agree to be bound by our Privacy Policy posted on the Site, which is incorporated into these Terms of Use.
These Terms of Use shall remain in full force and effect while you use the Site. These Terms and the agreement they form shall endure to the benefit of and be binding upon the parties and their respective legal or personal representatives, heirs, executors, administrators, successors or permitted assignees. If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.

There may be information on the Site that contains typographical errors, inaccuracies, or omissions, including descriptions, pricing, availability, and various other information. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Site at any time, without prior notice.

You covenant and agree to keep confidential and not disclose all confidential information provided by us for any purpose. This provision shall survive any termination of this agreement.
EXCEPT WHERE SUCH EXCLUSIONS ARE PROHIBITED BY LAW, UNDER NO CIRCUMSTANCE WILL THE COMPANY NOR ITS PARENT, SUBSIDIARIES, AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SERVICE PROVIDERS, CONTRACTORS, LICENSORS, LICENSEES, SUPPLIERS, OR SUCCESSORS BE LIABLE FOR NEGLIGENCE, GROSS NEGLIGENCE, NEGLIGENT MISREPRESENTATION, FUNDAMENTAL BREACH, DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT, BREACH OF CONTRACT, BREACH OF PRIVACY, OR OTHERWISE, EVEN IF THE PARTY WAS ALLEGEDLY ADVISED OR HAD REASON TO KNOW, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OR RELIANCE ON, THE SITE, ANY LINKED WEBSITES OR SUCH OTHER THIRD-PARTY WEBSITES, NOR ANY SITE CONTENT, MATERIALS, POSTING, OR INFORMATION THEREON.
For greater certainty, but not to limit the above in any manner, in no event will we, including our respective agents, employees, shareholders, officers, directors, contractors, legal advisors ("Representatives"), parent companies, affiliates, subsidiaries, and each of its Representatives, be liable in any manner whatsoever for any damages of any kind, including but not limited to indirect, incidental, consequential, special or punitive damages arising out:
NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE LESSER OF: THE AMOUNT PAID, IF ANY, BY YOU TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING AND ONE HUNDRED DOLLARS ($100.00). CERTAIN LAWS AND INTERNATIONAL LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.
The above limitation of liability terms shall survive any termination of this agreement.
Dundas Life may refer you to third-party service providers, including insurers, brokers, or other professionals. Any such third parties are independent and are responsible for the services they provide. Dundas Life does not assume liability for any services provided by such third parties.
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Dundas Life Incorporated, including its subsidiaries, affiliates, and their respective directors, officers, employees, agents, contractors, service providers, licensors, suppliers, successors, and assigns, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to: (1) use of the Site; (2) breach of these Terms of Use; (3) any breach of your representations and warranties set forth in these Terms of Use; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Site with whom you connected via the Site. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
The above indemnification terms shall survive any termination of this agreement.
Except where prohibited by applicable law, you waive any right you may have to commence or participate in any class action against us related to any claim, and where applicable, you also agree to opt out of any class action proceedings against us.
In addition to the recognition that Dundas Life Incorporated is not a party to any agreement between you and any independent broker or life insurer, you hereby release us, including our Representatives, parent companies, affiliates, subsidiaries, and each of its Representatives from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with any dispute you have with an independent broker, an insurer or any third party, whether it be at law or in equity. This release includes, without limitation, any disputes concerning the performance, function, and quality of the services provided to a User by an independent broker, an insurer or any third party.
We will maintain certain data that you transmit to the Site for the purpose of managing the performance of the Site, as well as data relating to your use of the Site. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Site. You agree that we shall have no liability to you for any loss or corruption of any such data, and you hereby waive any right of action against us arising from any such loss or corruption of such data.
These Terms of Use and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be liable for any delays or failure in performance due to causes beyond our reasonable control, including but not limited to, acts of God, acts of any government, war, natural disasters, strikes, civil disturbance, work refusal, fires, equipment failure or the website or systems of a third party. If such a delay occurs, performance obligations shall be deemed extended for a period equal to the delay.
